1. Acceptance of Terms

Welcome to Aphrodites Rings. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Hephastos LLC (“we,” “us,” “our”) governing your use of the Aphrodites Rings mobile application and website (collectively, the “Service”).

By creating an account, accessing, or using Aphrodites Rings, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Service.

You must be at least 16 years old to use Aphrodites Rings. By using our Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this binding agreement.

2. Description of Service

Aphrodites Rings is a wellness and meditation mobile application designed to support mindfulness, mental health, and emotional connection. Our Service enables you to:

Monitor your real-time heart rate using your device’s sensors, HealthKit, Health Connect, or Bluetooth LE smart rings
Create or join “Heart Rings” to share your heart rate with invited members
Engage in shared meditation and mindfulness practices
Support your mental health and wellness journey

Critical Disclaimers:

Aphrodites Rings is NOT a medical device, NOT medical advice, and NOT intended for emergency use. This is a wellness app for meditation and mindfulness. See Section 6 for complete health disclaimers.

3. Eligibility

To use Aphrodites Rings, you must:

Be at least 16 years of age
Have the legal capacity to enter into a binding contract
Not be barred from using our Service under applicable laws
Comply with all local, state, national, and international laws and regulations

We reserve the right to refuse service, terminate accounts, or cancel access to anyone for any reason at our sole discretion.

4. User Accounts

Account Creation

To access certain features of Aphrodites Rings, you must create an account. When creating your account, you agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate and current
Maintain the security of your password and account credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use of your account

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

One Account Per Person

Each person may maintain only one account. Creating multiple accounts may result in termination of all your accounts.

Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, illegal activity, or any other reason at our sole discretion. You may delete your account at any time through the app settings.

5. Acceptable Use Policy

Permitted Uses

You may use Aphrodites Rings for lawful wellness, meditation, and mindfulness purposes in accordance with these Terms.

Prohibited Activities

You agree NOT to:

Use the Service for any illegal purpose or in violation of any laws
Harass, abuse, threaten, or harm other users
Impersonate another person or entity
Attempt to gain unauthorized access to other users’ accounts or data
Reverse engineer, decompile, or disassemble any part of the Service
Use automated systems (bots, scrapers) to access the Service
Transmit viruses, malware, or other malicious code
Spam or send unsolicited messages to other users
Violate any third-party rights, including intellectual property and privacy rights
Use the Service as a medical device or for emergency medical situations
Interfere with or disrupt the Service or servers
Collect or harvest personal information about other users

Violation of this Acceptable Use Policy may result in immediate termination of your account and legal action.

6. Health and Medical Disclaimers

These disclaimers are essential for your safety. Aphrodites Rings is a wellness app, not a medical tool.

NOT A Medical Device

Aphrodites Rings is NOT a medical device.

Aphrodites Rings is NOT FDA-approved or cleared as a medical device
It is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition
It is NOT a substitute for professional medical advice, diagnosis, or treatment
It is NOT suitable for medical emergencies or critical health situations
It should NOT be used to make medical decisions

NOT Medical Advice

Nothing in Aphrodites Rings constitutes medical advice. The Service provides wellness and mindfulness features for informational and recreational purposes only. All information, content, and features are provided “as is” without any medical recommendations.

NOT for Emergency Use

EMERGENCY WARNING

NEVER use Aphrodites Rings in emergency situations. If you are experiencing a medical emergency, call 911 (in the United States) or your local emergency services immediately. Do not rely on this app for urgent medical needs.

Heart Rate Accuracy Limitations

Heart rate measurements provided by Aphrodites Rings have significant limitations:

May Be Inaccurate: Heart rate readings may be inaccurate, incomplete, or unreliable
Environmental Factors: Measurements are affected by movement, skin contact, device placement, temperature, humidity, and other environmental conditions
Consumer-Grade Sensors: Mobile device sensors and consumer smart rings are NOT medical-grade instruments
No Medical Reliance: You should NOT rely on these measurements for any medical decisions or health assessments
Wellness Purpose Only: Heart rate data is provided for wellness, meditation, and informational purposes only

Consult Healthcare Providers

Always consult with qualified healthcare professionals for:

Medical advice, diagnosis, and treatment
Health-related questions and concerns
Interpretation of any health data or symptoms
Before starting any new wellness or meditation practice
If you have any pre-existing medical conditions

Assumption of Risk

By using Aphrodites Rings, you acknowledge and accept these limitations and agree to use the Service at your own risk. You understand that:

The Service is for wellness and meditation, not medical purposes
Heart rate data may be inaccurate and should not be relied upon
You are solely responsible for your health and medical decisions
We are not liable for any health-related consequences of using the Service

7. Heart Ring Feature

The Heart Ring feature allows invitation-based sharing of real-time heart rate data. By using this feature, you agree to the following:

You control who receives invitations to your Heart Ring
You are responsible for the people you invite
Invited members can see your real-time heart rate data
You can remove members or leave a Heart Ring at any time

No Guarantees

We do not guarantee:

Uninterrupted access to Heart Ring features
Accuracy of heart rate data shared within Heart Rings
That the feature will meet your specific needs
That the feature will remain available indefinitely (we may modify or discontinue it)

8. Payment Terms (Future Paid Features)

Aphrodites Rings is currently free to use. However, we may introduce paid features, subscriptions, or in-app purchases in the future.

If and when we introduce paid features:

We will provide clear pricing information before any charges
You will have the opportunity to opt-in to paid features
Subscription and refund terms will be clearly disclosed
We will update these Terms to reflect payment policies

Free features currently available will remain free unless we provide advance notice of changes.

9. Intellectual Property

Ownership

Aphrodites Rings, including all content, features, functionality, software, code, designs, graphics, logos, and trademarks, is owned by Hephastos LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Aphrodites Rings for your personal, non-commercial use in accordance with these Terms. This license does not include any right to:

Modify, copy, or create derivative works
Distribute, sell, or sublicense the Service
Reverse engineer or attempt to extract source code
Use our trademarks, logos, or branding without permission

Your Data

You retain all rights to your personal data, including heart rate data and account information. By using the Service, you grant us a license to use your data solely to provide and improve our services as described in our Privacy Policy.

10. Third-Party Services

Aphrodites Rings integrates with third-party services, including:

HealthKit (iOS) for heart rate data access
Health Connect (Android) for heart rate data access
Bluetooth LE devices (smart rings)
Google Sign-In for authentication
Apple Sign-In for authentication
Firebase for backend services

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for:

The availability, accuracy, or functionality of third-party services
Third-party data practices or privacy policies
Any damages or losses caused by third-party services

11. Data and Privacy

Your use of Aphrodites Rings is subject to our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to our collection, use, and sharing of your data as described in the Privacy Policy. When you delete your account, all your personal data will be immediately deleted from our servers.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, Hephastos LLC disclaims all warranties, including but not limited to:

Warranties of merchantability and fitness for a particular purpose
Warranties of accuracy, reliability, or completeness of any content or data
Warranties that the Service will be uninterrupted, secure, or error-free
Warranties that defects will be corrected
Warranties regarding the accuracy of heart rate measurements

We do not warrant that the Service will meet your requirements or that it will be compatible with all devices or operating systems.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Hephastos LLC, its officers, directors, employees, and agents shall NOT be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, or goodwill
Any health-related consequences or medical issues arising from use of the Service
Any damages resulting from reliance on heart rate data or other information provided
Any damages caused by third-party services or integrations
Any damages resulting from unauthorized access to your account

In no event shall our total liability to you exceed the amount you paid to us in the 12 months preceding the claim. Since the Service is currently free, this amount is $0.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Hephastos LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any third-party rights
Your violation of any applicable laws or regulations
Any health-related decisions you make based on the Service
Content you submit or share through the Service

15. Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising from these Terms or your use of Aphrodites Rings shall be resolved in the state or federal courts located in Westchester County, New York. You consent to the exclusive jurisdiction and venue of these courts.

Informal Resolution

Before filing any legal action, you agree to first contact us at legal@hephastos.io to attempt to resolve the dispute informally.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

Update the “Last Updated” date at the top of this page
Send you an email notification
Display a prominent notice in the app

Your continued use of Aphrodites Rings after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.

17. Termination

Your Right to Terminate

You may terminate your account and stop using the Service at any time by deleting your account through the app settings. Upon deletion, all your personal data will be immediately deleted.

Our Right to Terminate

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for:

Violation of these Terms
Illegal or fraudulent activity
Behavior that harms other users or the Service
Any other reason at our sole discretion

Effect of Termination

Upon termination:

Your right to use the Service immediately ceases
Your account and data will be deleted (subject to our Privacy Policy)
Sections of these Terms that by their nature should survive (disclaimers, limitations of liability, indemnification) will continue to apply

18. Miscellaneous

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hephastos LLC regarding the use of Aphrodites Rings and supersede all prior agreements and understandings.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms at any time without notice.
